By installing any GoodySell application from the Shopify App Store, creating an account, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

You must be at least 18 years old and have the legal capacity to enter into these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

• E-commerce optimization tools
• Analytics and reporting features
• Customer support and technical assistance
• Additional features as described in individual app listings

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice to users.

4. User Accounts and Registration

To use our services, you must have a valid Shopify store and install our applications through the Shopify App Store. You are responsible for:

• Providing accurate, current, and complete account information
• Maintaining the security and confidentiality of your account credentials
• Notifying us immediately of any unauthorized use of your account
• All activities that occur under your account
• Ensuring compliance with Shopify's Terms of Service

5.1 Subscription Fees

We offer free trials for most applications. During the trial period, you have access to full functionality. No payment is required to start a trial, and you can cancel anytime during the trial period without being charged.

You retain ownership of your store data and content. By using our services, you grant us a limited license to process your data solely for the purpose of providing our services to you.

8.3 Generated Content

Content generated by our AI tools (such as alt text) becomes your property once generated. However, you acknowledge that AI-generated content should be reviewed for accuracy and appropriateness before use.

9. Service Availability and Support

9.1 Service Level

We strive to maintain high service availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience technical issues that temporarily affect service availability.

9.2 Customer Support

We provide customer support via email and our support system. Support is available during business hours, and we aim to respond to inquiries within 24-48 hours.

10. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability for any claims shall not exceed the amount paid by you for our services in the 12 months preceding the claim
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We do not warrant that our services will be error-free, secure, or continuously available
• You use our services at your own risk and are responsible for backing up your data

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

You agree to indemnify, defend, and hold harmless GoodySell and its affiliates, officers, directors, employees, and agents from any claims, losses, damages, or expenses arising out of your use of our services, violation of these Terms, or infringement of any third-party rights.

You may terminate your use of our services at any time by uninstalling our applications from your Shopify store or contacting us to close your account.

We may suspend or terminate your access to our services immediately if you violate these Terms, fail to pay fees, or engage in prohibited activities.

12.3 Effect of Termination

Upon termination, your right to use our services ceases immediately. We will retain your data in accordance with our Privacy Policy and may delete it after the retention period.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through our services with at least 30 days' notice.

Your continued use of our services after the effective date of changes constitutes acceptance of the updated Terms. If you disagree with changes, you must discontinue use of our services.

These Terms are governed by the laws of Poland, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts in Warsaw, Poland.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GoodySell regarding the use of our services and supersede all prior agreements and understandings.
